1. Acceptance of Terms

By accessing, browsing, or using ClaimWSOL (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), along with our Privacy Policy. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ClaimWSOL ("we," "us," or "our").

If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of those changes.

These Terms apply to all visitors, users, and others who access or use the Platform, including but not limited to individuals who connect their digital wallets to interact with our services.

2. Eligibility and Account Requirements

2.2 Legal Capacity: You must have the legal capacity to enter into binding contracts. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2.3 Jurisdiction Restrictions: You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction. The Platform may not be available in all geographic locations, and we reserve the right to restrict access based on geographic location.

2.4 Wallet Connection: To access certain features, you must connect a compatible Solana wallet. You are solely responsible for maintaining the security of your wallet credentials, private keys, and seed phrases. We do not have access to, nor can we recover, your wallet credentials.

3. Description of Services

3.1 Platform Purpose: ClaimWSOL provides a decentralized platform for users to claim WSOL (White SOL) tokens through various mechanisms including direct claims, mining activities, and participation in the ecosystem. The Platform operates on the Solana blockchain and facilitates interactions with smart contracts.

3.2 Token Distribution: WSOL tokens are distributed from a vault pool according to predetermined rules and smart contract logic. The Platform does not guarantee token availability, claim success, or any specific token value.

3.3 Mining Features: The Platform offers point-based mining activities where users can earn rewards. Mining speed and rewards are determined by tier status, which is based on WSOL token holdings. Tier requirements and reward rates are subject to change.

3.4 Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of services.

4. User Responsibilities and Conduct

4.1 Account Security: You are solely responsible for maintaining the confidentiality and security of your wallet credentials, including private keys, seed phrases, and passwords. You agree to immediately notify us of any unauthorized access or security breach.

4.2 Accurate Information: You agree to provide accurate, current, and complete information when using the Platform and to update such information as necessary to maintain its accuracy.

4.3 Prohibited Activities: You agree not to:

• Use the Platform for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Platform or its related systems
• Interfere with or disrupt the Platform's operation or servers
• Use automated scripts, bots, or other means to exploit the Platform
• Engage in market manipulation, wash trading, or other fraudulent activities
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or any other malicious code
• Harvest or collect information about other users without consent

4.4 Compliance: You are responsible for compliance with all applicable tax obligations, securities laws, and regulations related to your use of the Platform and any tokens received.

5. Intellectual Property Rights

5.1 Platform Ownership: All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of ClaimWSOL or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes.

5.3 Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Platform without our prior written consent.

6. Risks and Disclaimers

6.1 Blockchain Risks: You acknowledge and accept the inherent risks associated with blockchain technology, including but not limited to:

• Transaction irreversibility - blockchain transactions cannot be undone or reversed
• Network congestion and variable transaction fees
• Smart contract vulnerabilities or bugs that may result in loss of funds
• Potential for blockchain forks or network upgrades affecting token functionality
• Regulatory uncertainty and potential changes in legal treatment of digital assets

6.2 Early Participant Considerations: WSOL tokens are distributed to early participants in the ClaimWSOL ecosystem. As with any early-stage digital asset project, participation carries inherent considerations:

• Token value may fluctuate based on market dynamics and ecosystem development
• Early participation involves accepting the evolving nature of the project
• Token utility and features may expand as the ecosystem matures
• Liquidity conditions may vary depending on market adoption and trading venues
• Participation is at your own discretion and should align with your risk tolerance

6.3 Informed Participation: We encourage all participants to conduct their own research and assessment before engaging with the Platform. While we strive to provide a valuable ecosystem experience, outcomes will vary based on market conditions, user engagement, and broader cryptocurrency trends. Consider consulting with appropriate professionals if you have questions about digital asset participation.

6.4 Platform Availability: We do not guarantee that the Platform will be available at all times or that it will be free from errors, bugs, or interruptions. The Platform is provided on an "as-is" and "as-available" basis.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLAIMWSOL, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Loss of tokens or other digital assets
• Business interruption or loss of business opportunities
• Damages arising from unauthorized access to your wallet or account
• Damages resulting from errors, bugs, or vulnerabilities in smart contracts
• Any other damages arising from your use of or inability to use the Platform

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

You acknowledge that the limitations in this section reflect the allocation of risk between the parties and that we would not provide the Platform without these limitations.

8. Indemnification

You agree to indemnify, defend, and hold harmless ClaimWSOL and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party, including other users; (d) your violation of any applicable laws or regulations; or (e) any content or information you submit through the Platform.

9. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of information.

By using the Platform, you consent to the collection and use of information as described in the Privacy Policy. We are committed to protecting your privacy and handling your data in accordance with applicable data protection laws.

10. Third-Party Services and Links

10.1 Third-Party Integrations: The Platform may integrate with or link to third-party services, including wallet providers, blockchain explorers, and RPC nodes. We are not responsible for the content, policies, or practices of third-party services.

10.2 No Endorsement: Any links to third-party websites or services do not constitute an endorsement by us. You access third-party services at your own risk and should review their terms and policies.

10.3 Wallet Providers: We do not control and are not responsible for the operation, security, or availability of third-party wallet services. Issues with wallet connectivity, transaction failures, or security breaches of third-party wallets are outside our control.

11. Modifications to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Material changes will be effective immediately upon posting to the Platform unless otherwise stated. We may notify you of significant changes through the Platform interface or other reasonable means.

It is your responsibility to review these Terms periodically for changes. Your continued use of the Platform after any modifications indicates your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must discontinue use of the Platform immediately. The "Last Updated" date at the bottom of these Terms indicates when the most recent changes were made.

12. Termination

12.1 Termination by You: You may stop using the Platform at any time. To disconnect your wallet and cease using our services, simply disconnect your wallet through the Platform interface.

12.2 Termination by Us: We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice, for any reason including:

• Violation of these Terms or applicable laws
• Fraudulent, abusive, or suspicious activity
• Security concerns or technical issues
• Extended periods of inactivity
• At our sole discretion for any other reason

12.3 Effect of Termination: Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve the dispute informally within sixty (60) days.

13.2 Binding Arbitration: If informal resolution fails, any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

13.3 Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

13.4 Exceptions: Either party may seek injunctive relief in any court of competent jurisdiction to prevent actual or threatened infringement or misappropriation of intellectual property rights.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with applicable international law principles for decentralized platforms.

By using the Platform, you agree that any legal action or proceeding shall be brought exclusively in courts of competent jurisdiction, and you consent to the personal jurisdiction of such courts.

15. Miscellaneous Provisions

15.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClaimWSOL regarding the Platform and supersede all prior agreements and understandings.

15.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to be enforceable to the maximum extent permitted by law.

15.3 No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment: You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.6 Language: These Terms are provided in English. Any translation is provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.
